ABOUT THE BIDDING: Absentee Bids: If you are unable to attend this auction in person and wish to place bids, Dorothy Dous, Inc. will make bids on your behalf. Our representatives will then try to bid on your behalf the item or items of your choice for the lowest bid possible, and never for more than the top amount you indicate. This service is free and confidential. Please note: Dorothy Dous, Inc. will not be responsible for error or failure to execute bids. Placing Absentee Bids: To place bids, please complete and submit the enclosed Absentee Bid section of the Bidders Form. Be sure to accurately record the page numbers, descriptions and the top price you are willing to bid for each item. Always indicate the "maximum" amount you would bid as if you were attending this auction yourself. Successful Bids: Successful bidders will be notified and invoiced within 5 days of the conclusion of the sale. Invoice is due and payable upon request. Deposit: Dorothy Dous, Inc. will not place Absentee Bids without prior receipt of a 25% deposit on your estimated bid amount. The deposit must be in the form of a Money Order or Banks Cashiers Check. We must receive this deposit at least 48 hours prior to the auction. We will not accept Visa, Mastercard or Discover for deposits. Bids and deposits must be sent to Tammy Evanich. Payment by personal check must be pre-approved by Dorothy Dous, Inc. at least 48 hours prior to the start of the auction. Important Note: We have tried to be as accurate as possible in our descriptions. We strongly recommend that you attend the preview to the auction to make your own inspections prior to bidding. Or, if you are planning to place an absentee bid, you are welcome to call for additional information about the pieces on which you intend to bid. THE FOLLOWING CONDITIONS OF SALE ARE THE ONLY TERMS AND CONDITIONS ON WHICH ALL ITEMS ARE OFFERED FOR SALE. 1. Bidders are required to register prior to the auction and will be issued a bidders number to be used at this auction. 2. On the drop of the auctioneers hammer, the highest bidder will be the purchaser. In the event of any dispute between two bidders, or in the event of doubt on our part as to the validity of any bid, the auctioneer will have the final discretion to determine either the successful bidder or to put the item back on the block and resell it. 3. All property is sold "as is where is" condition. This condition is strictly by definition only as to the physical condition of the item sold. As a prospective buyer we stress that you inspect every piece prior to bidding. Dorothy Dous, Inc. makes no guarantees, warranties, or representations expressed or implied with respect to the property, correctness or accuracy of this catalog or the descriptions of the authenticity of authorship, physical condition, size, quantity, rarity, importance or provenance. Statements, whether oral or written, shall not be deemed as a guarantee, warranty or representation. Prospective bidders are encouraged to closely inspect the property being sold prior to bidding to determine its condition. Refunds or credits will not be issued. 4. Several articles to be sold will have reserves. Dorothy Dous, Inc. reserves the right to execute absentee bids as a convenience to our clients who are not present at the auction. The auctioneer reserves the right to accept or reject an opening bid that is below the reserve amount of the article offered, the auctioneer may reject the same and withdraw the article from the auction. If, having acknowledged an opening bid, the auctioneer decides that any advance thereafter is insufficient, he may reject the advance and withdraw the article from the auction and continue to the next article. 5. A buyers premium of 10% will be added to the successful bid price and is payable as part of the total purchase price by the buyer. 6. Payments must be made on the day of purchase. Cash, certified checks, money orders or personal checks with a bank letter guaranteeing the amount of the check will be accepted, as well, as Visa, MasterCard and Discover. Payment by personal check must be pre-approved by Dorothy Dous, Inc. at least 48 hours prior to the start of the auction. 7. Transfers of items will not be permitted to be made from one purchaser to another for any reason. 8. On the fall of the auctioneers hammer, title will pass to the highest bidder, as acknowledged by the auctioneer, subject to the bidders fulfilling all of the conditions set forth herein. The successful bidder assumes full risk and responsibility and agrees to pay the full purchase price. Dorothy Dous, Inc. will bid on behalf of absentee bidders pursuant to their specific requests. 9. Dorothy Dous, Inc. is not responsible for the acts or omissions of carriers or packers of the purchased lots, whether or not they are recommended by us. Packing and handling of purchased lots by us is at the entire risk of the purchaser. In no event will Dorothy Dous, Inc. be liable for any damage, regardless of the cause. 10. All items purchased must be removed at the conclusion of the auction. Buyers must provide their own packing materials. 11. This is a privately owned and operated auction. We reserve the right to refuse admittance to any person for any reason, or to eject from the auction site anyone selling or attempting to sell their own merchandise. 12. We reserve the right to withdraw any item prior to the auction without notice. 13. Please, no children during this auction. 14. If any of these conditions are not complied with by the purchaser in addition to the remedies available to us and the consignor by law, including and without limitation the right to hold the purchaser liable for the total purchase price. Dorothy Dous Inc. will have the option to cancel the sale, retaining all deposits as liquidating damages; resell property at our next auction with out reserve, and hold the purchaser deficiency from the original purchase price. A defaulting purchaser will be deemed to have granted Dorothy Dous, Inc. a security interest in any property in our possession owned by such purchaser which we retain as collateral security for such purchasers obligations to us. We shall have all the rights afforded a secured party under the uniform Commercial Code with respect to such property and we may apply against such obligations all moneys held or received by us for this account due from the purchaser. Payment made and received is considered as "collected funds" at our bank only. Items will not be released for shipment until such time as we have "collected funds" at our bank. 15. In no event will Dorothy Dous, Inc.s liability to a purchaser ever exceed the purchase price actually paid. 16. These conditions of sale, as well as the purchasers and our respective rights and obligations thereunder, shall be governed by and be construed and enforced in accordance with the laws of the Sate of Pennsylvania. By bidding at this auction, whether present in person or by agent, telephone or other means, the purchaser shall be deemed to have consented to the exclusive jurisdiction of the State Court and of the federal courts in the State of Pennsylvania. |
